NLRB Regains Quorum as Senate
Confirms Trump labor Slate
Labor Unions Must Protect Their Members!
In a December 19, 2025 Senate vote (53–43), the U.S. Senate confirmed a package of 97 Trump administration nominees, including key positions that allow the National Labor Relations Board (NLRB) to regain its quorum and resume regular operations. The confirmed NLRB officials include:
- Scott Mayer and James Murphy as NLRB Board Members.
- Crystal Carey as NLRB General Counsel.
The NLRB has regained its quorum after the Senate confirmed Trump administration labor nominees, allowing the agency to resume issuing decisions and enforcing federal labor law after nearly a year of paralysis. This development signals a likely shift toward employer-favorable interpretations of labor statutes, creates immediate operational capacity to address the case backlog, and intensifies political and legal debates over labor policy and agency independence.
This does not bode well for Labor Unions and Organizations. In the last Trump administration the Republican NLRB was extremely hostile towards Labor. Even going so far as to penalize unions with fines if they did not have electronic records of all grievances and arbitrations. It is imperative that Unions acquire tools to protect themselves from the coming onslaught.
Union Built PC has written extensively and has sounded the warning about a Republican controlled National Labor Relations Board gone rogue. The Directives issued to punish unions for ‘negligent’ behavior such as losing an employees’ complaint, or not returning phone calls when the worker has questions,” is an effort to bring consistency to how the NLRB enforces cases when a union may have breached their duty of fair representation in regards to the mishandling of employee grievances.
As the General Counsel’s office wrote:
“Regions issuing a complaint in these cases should argue that generally, a union which loses or misplaces a grievance engages in gross negligence unless it has a system or procedure in place.”
Former NLRB General Counsel Peter B. Robb in the first Trump administration directed NLRB agents to spend their time investigating – and litigating – these often-frivolous complaints against unions, which will necessarily be at the expense of pursuing cases against employers. The Trump administration has directed NLRB agents to focus on going after unions, rather than employers.
